The Registration Act, 1908, the Transfer of Property Act, 1882 and the Real Estate (Regulation and Development) Act, 2016 mandates the registration of an agreement for sale of an immovable property. By registering the agreement for sale of an immovable property, it becomes a permanent public record. Further, a person is considered as the legal owner of an immovable property only after he gets such property registered in his name.
Carpet area is the actual usable floor space inside a unit — the area within the internal walls that you can furnish and walk on. It excludes wall thickness, balconies and shared common areas, so it is smaller than the built-up area often quoted in brochures. When comparing units, always ask for the carpet area for a true like-for-like comparison.
Certain property transactions in Kenya qualify for tax relief — for example transfers between spouses, some family transfers, and first-time buyers under approved affordable-housing schemes may pay reduced or no stamp duty. Because eligibility depends on your circumstances, we work with qualified advocates who confirm exactly which exemptions apply before you commit.
Stamp duty is normally payable on a property transfer in Kenya — currently 4% of the value in urban areas and 2% in rural areas. However, transfers by way of gift or between spouses, and certain family transfers, may be exempt or attract only a nominal duty. To process a purchase we typically need a copy of your national ID or passport, your KRA PIN certificate, and a few passport-size photographs.
